The following terms and conditions („Terms“) govern your use of all games, services, and products (collectively „Game Matter Services“) developed, provided, and operated by Game Matter GbR, a civil law partnership based in Hamburg, Germany. This includes, but is not limited to, the MMORPG „Duel Revolution.“
We kindly ask you to read these Terms carefully, as they set forth your rights and obligations as a user of our services. By using our services, you agree to these terms. If you do not agree with the Terms, we kindly ask you not to use our services.
To All Parents!
The safety and well-being of young players are important to us. We encourage all parents and guardians to regularly monitor their children’s online activities and ensure they are acting in a safe and responsible environment. The Internet and online games can pose risks. Please take your responsibility as a parent or guardian seriously and talk to your children about safe online behavior.
1. ACCOUNT:
1.1. Account Registration
Each user is allowed only one account. An account is automatically created as soon as a user, who has not yet had an account, uses one of our services for the first time and accepts these Terms.
1.2. Account Responsibility
The user is solely responsible for all activities conducted through their account.
1.3. Account Transfer
Accounts may not be sold, transferred, licensed, or otherwise conveyed to third parties without written permission.
1.4. Account Suspension and Deletion
We reserve the right to suspend or delete accounts if they are found to violate these Terms or other policies.
1.5. Privacy
The data provided during registration will be stored and processed in accordance with our privacy policy.
1.6. Account Recovery
In the event of a lost or hacked account, recovery will be attempted but is not guaranteed. Users are advised to provide their email address in the game to secure their account further. Without this email address, account recovery is usually not possible.
1.7. Inactivity
In case of prolonged inactivity of an account, we reserve the right to delete or disable it. Before such a measure is implemented, we will inform the account user in advance via a warning email to give them the opportunity to keep the account active.
1.8. Termination
Users may request the deletion of their accounts at any time via our dedicated web page: https://remove-account.duel-revolution.com/remove. Upon initiating the deletion process, the account will remain active for a 30-day grace period, during which the user may choose to reactivate their account by logging in to the game and confirm the reactivation. If no reactivation occurs within this period, the account, along with all associated data and progress, will be permanently deleted. We will send an email to confirm the initiation of the deletion process and another email 24 hours before the account is permanently deleted to provide a final opportunity for reactivation.
2. LICENSE:
2.1. License Grant
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable, and non-exclusive license to use the Game Matter Services for your personal, non-commercial use.
2.2. Ownership Rights
All rights, titles, and interests in and to the Game Matter Services, including but not limited to copyrights, trademarks, patents, and other intellectual property rights, remain with Game Matter GbR.
2.3. Prohibited Actions
You are not permitted to modify, copy, reproduce, hack, rent, lease, sell, transfer, publish, publicly display, distribute, or commercially exploit the Game Matter Services unless expressly authorized by us in writing.
2.4. Updates and Changes
We may update or modify the Game Matter Services at any time. These updates or changes may add or remove features or change the operation of the Game Matter Services.
2.5. Usage Restrictions
The Game Matter Services may only be used within the legally permissible framework. Any use that violates applicable law is strictly prohibited.
2.6. Access Restrictions
We reserve the right to restrict or terminate access to the Game Matter Services or parts thereof, for any reason and without prior notice.
2.7. License Termination upon Account Termination
In the event of termination or cancellation of your account for any reason, the license granted to you to use the Game Matter Services is automatically terminated. Upon termination of the license, you must cease all use of the Game Matter Services and remove all copies or installations.
3. VIRTUAL GOODS AND GAME CURRENCIES
3.1. General on Virtual Goods and Game Currencies
Virtual goods, such as skins, Evos, or Evo-Cubes, and game currencies are digital contents that can be used within our services. They have no real monetary value and do not represent real goods or currencies.
3.2. License Instead of Ownership
The provision of virtual goods and game currencies does not constitute a transfer of ownership. Users are granted only a limited, revocable, non-transferable license to use these contents within the service for which they were acquired.
3.3. Purchase of Game Currency
Players can purchase game currencies with real money. The exact price and available purchase methods will be displayed in the respective service.
3.4. Use and Restrictions of Game Currencies
Purchased game currency may only be used in the service in which it was acquired. It may not be used or transferred outside of the game, in other services, or on other platforms.
3.5. No Refunds
Purchases of virtual goods and game currencies are final and non-refundable, non-exchangeable, and non-transferable, unless expressly provided in these Terms or applicable law.
3.6. Revocation of License
We reserve the right to revoke the license to use virtual goods and game currencies at any time and for any reason. Such a revocation may result in the deletion or deactivation of the affected virtual good or game currency.
3.7. No Real Money Value
Virtual goods and game currencies cannot be exchanged for real money, goods, or other services and have no monetary value.
3.8. Changes and Deletion of Virtual Goods
We reserve the right to make changes to virtual goods or to remove them completely at any time. This can happen without prior notice and at our discretion. Players have no claim to refunds or compensation in such cases.
4. INTELLECTUAL PROPERTY:
4.1. Ownership Rights
Most content, including but not limited to games, texts, graphics, designs, logos, images, music, sounds, and all other materials in our services, is the intellectual property of Game Matter GbR and is protected by copyright and other intellectual property rights. In cases where certain content is not directly owned by us, we have the necessary rights and licenses to use these contents in our services.
4.2. License Granting
While you may use our services, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our content solely for non-commercial purposes, provided that you comply with all legal notices and these Terms.
4.3. Restrictions
You are not permitted to copy, reproduce, distribute, publish, sell, license, transfer, or otherwise exploit content from our services without having obtained our written consent first.
4.4. Feedback
Any feedback, comments, or suggestions you provide to us regarding our services may be used by us without restriction or compensation. You hereby grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and distribute such materials.
4.5. Violations
In the event of violations of our intellectual property rights, we reserve the right to take appropriate legal action, and your account may be suspended or deleted.
5. CODE OF CONDUCT
5.1. General Behavior
Users are encouraged to always be respectful and polite to other users. Offensive, threatening, harassing, discriminatory, or otherwise inappropriate behaviors are strictly prohibited.
5.2. Prohibited Content
Uploading, sharing, or distributing illegal, obscene, pornographic, glorifying violence, or racist content, as well as content that incites hate or violence, is strictly prohibited.
5.3. Cheating and Hacks
The use of cheats, bots, hacks, or other software tools that affect gameplay in any way or provide unfair advantages is not allowed.
5.4. Trading
Trading, buying, or selling game accounts, virtual goods, or game currency for real money or other considerations outside the intended game system is prohibited.
5.5. Collecting Information
Collecting information about other users without their express consent, including but not limited to personal data or information, is prohibited.
5.6. Multiple Accounts and Account Sharing
Creating multiple accounts or sharing accounts with other users can lead to restrictions or suspension of the involved accounts.
5.7. Manipulation
Any attempts to manipulate, hack, or disrupt our services, platforms, or systems in any way are strictly prohibited.
5.8. Abuse of Reporting Systems
Intentionally and falsely reporting other users or content to harm or harass them is not allowed.
5.9. Consequences of Violations
Violations of these rules of conduct can lead to temporary or permanent sanctions, including but not limited to mutes, bans, or deletion of accounts.
6. DATA PROTECTION
6.1. Monitoring and Data Collection
To ensure the security and integrity of our services and to combat
unauthorized activities such as hacking, fraud, and cheating, we reserve the right to monitor user behavior within our services. This may also serve to continuously improve our services and provide an optimal user experience.
6.2. Type of Collected Data
We collect and store data relevant to the above purposes. This may include, for example, gameplay statistics, user behavior, or other information associated with the user account.
6.3. Privacy Policy
All details regarding the nature, manner, and purpose of data processing, as well as users‘ rights concerning their data, are contained in our privacy policy. 6.4. Consent

Users have the right to withdraw their consent to data processing at any time. However, please note that withdrawing consent may limit or make it impossible to use our services.
7. DISCLAIMER
7.1. „As Is“ Provision
Our services are provided „as is“ and „as available,“ without any express or implied warranty. This includes, without limitation, any warranty of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.
7.2. No Guarantee of Error-Free Operation
Although we constantly work to improve our services, we cannot guarantee that they will always be error-free, uninterrupted, or secure. We are not liable for any downtime, errors, or security breaches.
7.3. No Liability for Damages
Under no circumstances will Game Matter GbR or its developers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our services, even if we have been advised of the possibility of such damages.
7.4. Limitation of Liability
Our total liability in connection with our services, regardless of the cause of action or claim (whether due to breach of contract, negligence, or otherwise), is limited to the amount you have paid us in the twelve months preceding the event leading to liability.

8. CHANGES TO THE TERMS
8.1. Right to Amend
Game Matter GbR reserves the right to change or replace these Terms at its discretion and at any time.
8.2. Acceptance of Changes
Should we make changes to these Terms, users will be informed of the updated conditions through a popup window upon the next start of „Duel Revolution.“ Users must agree to the amended Terms to continue using the game. If users do not agree with the amended Terms, they are free to discontinue using our services.
8.3. Review of Terms
We recommend that you regularly review these Terms to ensure you are informed of any changes and continue to agree with them.
